1. Acceptance of Terms

By clicking the "Start for Free" button, creating an account, or otherwise using the Vitalux application and website, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not access or use the service.

2. Description of Services

Vitalux provides a web-based and mobile application designed to help individuals and small businesses manage their daily tasks, schedules, and habits. Our core features include:

  • A daily planner for organising your workflow.
  • Task management tools to capture and complete to-dos.
  • Focus timers to encourage deep work sessions.
  • Habit tracking to build consistent routines.

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time without prior notice.

3. User Accounts and Responsibilities

To access certain features of Vitalux, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate, current, and complete information about yourself during the registration process and to update such information to keep it accurate, current, and complete.

4. Acceptable Use Policy

When using Vitalux, you agree not to:

  • Attempt to gain unauthorized access to the service, other accounts, or computer systems.
  • Interfere with or disrupt the service or servers or networks connected to the service.
  • Upload files that contain viruses, malware, or any other harmful code.
  • Violate any applicable local, state, national, or international law.
  • Use the service for spamming, unsolicited marketing, or illegal activities.

5. Subscription and Payment Terms

Vitalux offers a free trial period and subscription plans. You will be charged the then-current rate for the subscription plan you selected. Payments are processed automatically on a recurring basis.

You may cancel your subscription at any time. Your access to the premium features will continue until the end of the current billing cycle.

We do not provide refunds for partial months or for unused portions of a billing cycle.

6. Intellectual Property

The Vitalux application, including all source code, databases, and functionality, is the exclusive property of Vitalux Inc. and is protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of any data you input into the service, provided it does not infringe on the intellectual property rights of others. You grant Vitalux a non-exclusive, worldwide, royalty-free license to use your data solely for the purpose of providing and improving the service.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Vitalux shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

Our total liability to you for any claims arising out of or related to your use of the service shall not exceed the amount you paid, if any, for the service in the twelve (12) months prior to the claim.

8. Governing Law and Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with the laws of [Jurisdiction, e.g., the State of California], without regard to its conflict of law provisions.

Any legal action or proceeding between you and Vitalux will be brought exclusively in the federal or state courts located in [City, State], and you hereby submit to the personal jurisdiction of such courts.
